These Terms of Service (Terms) govern access to and use of the Truckets website, Trucking Portal, Driver Mobile App, dispatch-ticket bundles, and related services (collectively, the Services) provided by Central Coast DesignPros, LLC, doing business as Truckets (Truckets, we, us, or our). By accessing or using the Services, you agree to these Terms on behalf of yourself and, if applicable, the trucking company or other organization you represent (Customer).

 

1. Eligibility and authority

You must be at least 18 years old and authorized to bind the Customer to these Terms. If you use the Services for a company, you represent that you have authority to accept these Terms on that company’s behalf.

 

2. Account access and security

Customers are responsible for maintaining accurate account information, controlling user roles, protecting passwords and company access codes, and promptly notifying Truckets of suspected unauthorized access. You are responsible for activity occurring through your account to the extent permitted by law.

 

3. Customer data and operational records

Customer retains responsibility for the accuracy, legality, and rights necessary to submit operational data, including dispatch details, ticket information, signatures, photos, driver information, and customer information. Customer is responsible for reviewing ticket, billing, payroll, settlement, and operational records before relying on them for business, tax, employment, regulatory, or payment decisions.

 

4. Dispatch-ticket bundles and payment

Dispatch-ticket bundles provide credits for eligible active driver dispatches as described in the applicable checkout flow. Unless otherwise stated at purchase, one dispatch ticket represents one driver’s accepted dispatch for one operating day and may include multiple trips or loads within that dispatch. Prices, bundle terms, taxes, payment-processing charges, and any applicable discounts are presented at checkout. Purchased credits are non-refundable except where required by law or expressly stated in writing by Truckets.

 

5. Optional features

Some features, including Time & Attendance, GPS-related functions, messaging, notifications, or integrations, may be optional, configuration-dependent, subject to device permissions, or unavailable in certain circumstances. Time & Attendance is not enabled by default for every company. Customers are responsible for deciding whether to enable it and for compliance with applicable wage, hour, privacy, labor, and recordkeeping requirements.

 

6. Acceptable use

You will not misuse the Services, interfere with their operation, attempt unauthorized access, upload malicious code, violate another person’s rights, use the Services for unlawful activity, or use the Services to process data in violation of applicable law. You will not reverse engineer or circumvent security controls except to the extent such restriction is prohibited by law.

 

7. Mobile, location, and communications

The Driver Mobile App may use device features such as camera, storage, notifications, and location when enabled by the user and permitted by the Customer’s settings. Location-related functionality is intended for active operational work and depends on device settings, connectivity, and permissions. Carrier, mobile-network, and device charges may apply.

 

8. Privacy

Our collection and use of personal information is described in the Truckets Privacy Policy, which is incorporated into these Terms by reference. Customer is responsible for providing notices and obtaining permissions required for its drivers, employees, contractors, customers, and other users.

 

9. Service availability and changes

We may modify, update, suspend, or discontinue portions of the Services. We will use commercially reasonable efforts to maintain the Services, but do not guarantee uninterrupted, error-free, or secure operation at all times. Customer should maintain its own records and reasonable backups appropriate to its business needs.

 

10. Intellectual property

Truckets and its licensors retain all rights, title, and interest in the Services, software, branding, documentation, and related intellectual property. Subject to these Terms and payment of applicable fees, Truckets grants Customer a limited, non-exclusive, non-transferable, revocable right for authorized users to access and use the Services for Customer’s internal business operations.

 

11. Disclaimers

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. TRUCKETS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TRUCKETS DOES NOT PROVIDE LEGAL, TAX, EMPLOYMENT, WAGE-AND-HOUR, REGULATORY, OR PROFESSIONAL ADVICE.

 

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUCKETS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION. TRUCKETS’ TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNTS PAID BY CUSTOMER TO TRUCKETS FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR US$100, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations, so some of these limits may not apply.

 

13. Indemnification

Customer will defend, indemnify, and hold harmless Truckets and its affiliates, officers, employees, and agents from claims, damages, liabilities, costs, and expenses arising from Customer data, Customer’s use of the Services in violation of these Terms or applicable law, or Customer’s relationship with its users, drivers, employees, contractors, or customers.

 

14. Suspension and termination

We may suspend or terminate access to the Services if we reasonably believe there is a security risk, nonpayment, violation of these Terms, unlawful conduct, or risk of harm. Customer may stop using the Services at any time, subject to any outstanding payment obligations. Sections that by their nature should survive termination will survive.

 

15. Governing law and disputes

These Terms are governed by the laws of California, USA, excluding its conflict-of-law rules. Any dispute will be resolved in the courts located in California, USA, unless applicable law or a separately executed agreement requires another process.

 

16. Changes to these Terms

We may update these Terms from time to time. Updated Terms will be posted on Truckets.com with a revised Effective Date. Continued use after the effective date means you accept the updated Terms to the extent permitted by law.
